New Book “Inherent Powers of High Court – A Commentary on Section 528 of the BNSS, 2023

The enactment of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 marks a watershed moment in India’s criminal jurisprudence, replacing the nearly five-decade-old Code of Criminal Procedure, 1973. Among its many provisions, Section 528 — which codifies the inherent powers of the High Courts — stands as a crucial safeguard ensuring that procedural rigidity does not eclipse justice.

The book, Inherent Powers of High Court – A Commentary on Section 528 of the BNSS, 2023, offers an authoritative and timely examination of this provision. It traces the evolution of inherent powers from the CrPC to the BNSS, dissects landmark judicial pronouncements, and contemplates the interpretational challenges likely to arise under the new procedural framework.

The recently released book, provides a deep and timely exploration of this vital provision. The work blends doctrinal analysis with practical insight, tracing the evolution of inherent powers from the CrPC to the BNSS while analysing judicial precedents and highlighting future challenges under the new law.

Authored by Ms. Surbhi Das, is a distinguished legal academic and researcher with a strong foundation in International Law. She earned her undergraduate degree in law from SRM University and pursued her LL.M. at the Madras University. With a passion for legal scholarship, she has contributed numerous articles to reputed journals, including. In addition to her research pursuits, she serves as a reviewer for IJIRT, reflecting her active engagement in academic peer review. Ms Surbhi Das is currently pursuing her PhD from Saveeta University. Her interests lie at the intersection of and she remains committed to advancing legal discourse through both teaching and writing.

Her Co-Author Mr. I Madhav Ganesh, is an engineering graduate and accomplished banking professional with over 15 years of extensive experience in Anti-Money Laundering, bereavement services, regulatory compliance, and sales management. Throughout his career, he has developed a deep understanding of financial regulations and risk management within the banking sector. Currently, he is pursuing an LLB degree at Hindustan University, aiming to integrate his practical expertise with a robust legal education to further contribute to the fields of financial law and compliance.
